JOB SUMMARY
Reporting to the Managing Attorney in the Office of Legal Affairs, will work under limited supervision to provide legal counsel on business law and general legal issues, and favorably resolve disputes, claims and lawsuits (excluding medical risk management and healthcare regulatory matters) arising within an academic medical center. Assists internal clients in structuring contracts within legal constraints while striving to achieve business needs. Reviews and analyzes legal issues arising within University business areas including but not limited to Business Affairs, Real Estate, Facilities Management, Information Resources, Information Security, Technology Development, Sponsored Research, and Conflicts of Interest. Performs all functions of a legal professional employed as in-house counsel as directed by Legal Affairs leadership, including communications with internal clients and preparation of legal opinions, memoranda, documents, reports, and presentations.

Experience developing relationships with senior management and advising on complex business matters is preferred. Real estate law experience is preferred.

EXPERIENCE AND EDUCATION

Required

Education
J. D. degree from an accredited law school

Experience
4 years of consecutive years of experience actively engaged in the practice of law with a focus of business law and
Effective written/oral communication skills and ability to manage a broad range of complex issues in a collaborative environment and
Previous litigation practice and case management experience.

Licenses and Certifications
License to practice law in Texas or for out-of-state applicants licensed in another jurisdiction, admission to the Texas State Bar without examination within six months of hire date

Previous experience in higher education, at a state agency, in healthcare, or at an academic medical center

JOB DUTIES

Advises the University in contractual negotiations and disputes. Areas of responsibility include but are not limited to real estate, intellectual property, construction law, research, and general contract matters. Assists internal clients in structuring contracts within legal constraints while striving to achieve business needs.
Reviews and analyzes legal issues arising within University business areas including but not limited to Business Affairs, Real Estate, Facilities Management, Information Resources, Information Security, Technology Development, Sponsored Research, and Conflicts of Interest.
Provides general legal support and advice regarding the University‿s proposed strategic initiatives.
Manages claims and lawsuits (other than medical malpractice) filed against the institution and its employees, including pre-litigation investigation, document preservation and discovery practice, preparing for and attending depositions, motions practice, hearing preparation, mediation, trial preparation, and appeals; manages the University‿s response to contract disputes submitted to the State Office of Administrative Hearings pursuant to Texas Government Code Chapter 2260; assists the Office of General Counsel at UT System and the Office of the Attorney General in every aspect of lawsuits and administrative hearings; assists with the University‿s response to complaints, charges, audits or investigations from external state and federal agencies.
Performs all functions of a legal professional employed as in-house counsel as directed by Legal Affairs leadership, including communications with internal clients and preparation of legal opinions, memoranda, documents, reports, and presentations.
Assists with responses to subpoenas in federal and state court civil and criminal matters and subpoenas served by regulatory agencies.
Advises on new and existing policy initiatives; drafts, reviews, revises and interprets institutional policies and procedures.
Develops and provides training on a broad range of legal issues in areas such as policy, constitutional issues, contract negotiations, and compliance with federal and state laws and regulations. Interprets and advises internal clients on UT System policies and UT System Regents Rules.
Processes pre-litigation tort claims involving the University in accordance with the Texas Tort Claims Act; coordinates the submission of insurance claims to insurers and collection of sums from either insurers or individuals for the repair of damage to University property.
Serves on or advises institutional committees in areas such as conflicts of interest, research, policy, compliance, information security and data security.
Performs other duties as assigned.
